This was posted a couple days ago on the xboxlive website, sorry if someone else already mentioned this the texas sueing microsoft thing. Which btw I doubt is going to win. I'm sure in the TOS it says stuff about not garunteeing 24/7 access etc etc etc. But it looks like they want to give everyone a free game see if it will make em happy. I do agree though Microsoft had no excuse to not be prepaid for the holiday season, They really just neglected the whole thing.

edit: ah i guess it is being talked about in the other thread, probaly shoulda read the later pages in it first.
